Bitwise Asks SEC To Protect Funds Relying On Token Status Filings
Summary
Bitwise filed an October 21 supplemental comment on the SEC’s proposed Regulation Crypto Assets framework. It asks the SEC to clarify when fund managers can rely on an issuer’s Form TR filing about a token’s status, what good-faith protections apply if the filing is later challenged, and how reliance affects investment-company and adviser definitions. Bitwise argues managers often must make decisions using public information unavailable to issuers’ internal records. The letter says filing Form TR should not itself imply anything about the token’s prior legal status. These are Bitwise’s requests, not adopted rules or an SEC determination about any token.
