Elon Musk's xAI Sues Minnesota to Kill the US's First AI Nudification Law
xAI sued Minnesota Attorney General Keith Ellison in federal court to block HF 1606, Minnesota’s new AI “nudification” law. xAI says the statute is an overbroad, content-based restriction on speech because it imposes strict liability on platforms for realistic AI images showing certain body parts, even without consent, knowledge, or distribution. The company argues the law could punish benign or protected uses such as satire, swimsuit or beach images, and even images created by the subject themselves. xAI says Minnesota used an overly broad definition of “intimate part” and rejected safeguards like a scienter requirement or safe harbor for good-faith moderation. Minnesota passed the law after a man generated sexual images of dozens of women from social media photos. xAI says federal law already addresses nonconsensual intimate deepfakes more narrowly. The company seeks an injunction before the law takes effect Saturday.
