Binance’s EU services face scrutiny over licensing exemption: Report

European regulators are examining whether Binance is improperly using MiCA’s “reverse solicitation” exemption to keep serving EU customers without full authorization. ESMA and regulators in France, Germany, and Greece are reportedly reviewing whether the exemption is being used to sidestep MiCA rules, which only allow service when customers initiate contact entirely on their own. Binance had withdrawn a Greek MiCA application in June and said it would seek authorization elsewhere in the EU, while also stating it continues pursuing MiCA approval and aims to operate compliantly in Europe. ESMA is also pushing for stronger enforcement powers over non-EU crypto firms that solicit EU investors without authorization. Binance does not appear on ESMA’s non-compliant provider list, which is non-exhaustive and updated from national authority information.
