Coinbase Releases Treasure Trove of SEC Docs on Ethereum, XRP and More
New York prosecutors sought the SEC's opinion on whether Ethereum is a security to strengthen their case against KuCoin in 2023, as revealed by SEC records obtained through a Coinbase FOIA request. In a June 2023 email, Shamiso Maswoswe from the New York Attorney General’s office requested the SEC to file an amicus brief supporting the classification of Ether as a security, emphasizing the importance of investor protection. The records highlight ongoing uncertainty among regulators regarding the classification and regulation of digital assets, despite active legal actions against crypto firms. Additionally, a December 2021 letter from the SEC to Ripple Labs expressed concerns about potential violations of federal securities laws related to Ripple's Liquidity Hub, which Ripple contested, asserting no obligation to consult with the SEC.
