The CFTC said its review found the Gemini complaint would not have been filed under current enforcement standards, citing problems with witness credibility, missing evidence, and improper use of regulatory authority. The parties later asked the court to vacate the consent order or lift remaining injunction terms; the $5 million penalty was already paid and will not be refunded.
