Bitpanda Hit With Europe's First Published MiCA Penalty in Austria
Austria’s Financial Market Authority fined Bitpanda €70,000, the first publicly disclosed enforcement penalty under the EU’s Markets in Crypto-Assets Regulation (MiCA). The FMA said Bitpanda committed procedural disclosure breaches: it failed to submit a required crypto-asset white paper at least 20 working days before publication, published marketing before the white paper, and omitted required disclaimer and contact details in another promotional message. The case was resolved through an accelerated procedure and is legally final. No fraud or investor-loss allegations were made. The penalty highlights how European regulators are beginning to enforce MiCA as its rollout continues across the bloc, with existing firms under pressure to complete compliance and secure authorization.
