Do Kwon Tries To Delay SEC’s Terraform Trial so He Can Attend
Do Kwon's legal counsel has requested a U.S. court to postpone the Securities and Exchange (SEC) trial against him and his former company, Terra, due to uncertainty over his extradition from Montenegro. The extradition process has been delayed as Kwon's counsel appealed a high court's decision to extradite him, leading to a retrial ordered by the Appeals Court due to procedural issues. The trial is currently set to begin at the end of January, but Kwon's counsel does not expect him to be in the U.S. until February or March. If the court does not postpone the trial, Kwon's counsel requests that the jury be instructed to view his absence and inability to testify as not unduly prejudicial. Both Kwon and the SEC have filed for summary judgment in their legal dispute, asking a federal judge to decide in their favor without a trial.
